北京商报：转载不付稿费 作家六六诉《读者》

著作权人“冷眼”、代理机构不一、法律监管缺失

文著协稿酬查询系统运营举步维艰

　　“转载且不付稿费，我觉得有必要上法庭了。”近日，《蜗居》作者、知名女作家六六在微博上表示了对国内最大文摘类杂志《读者》的愤怒，再次将文字作品转载稿费问题引入公众的视线，同时也让上线不足一月的文著协稿酬查询系统遭遇尴尬的处境，这个以替著作权人追讨转载作品稿费为职责的系统如今却是“举步维艰”，面临诸多难题。

　　文字转载引发的思考

　　5月3日，作家六六在微博上表示：“有人说在新一期《读者》杂志17页看到六六语录。我已委托律师发律师函。转载且不付稿费，我觉得有必要上一下法庭了。”

　　六六表示，《读者》杂志2007年要与自己签一份签约作者的合约，被她拒绝了。之后《读者》就不再遵从约定付稿酬了。六六多次跟《读者》的编辑声明拒绝转载文字之后，《读者》从此再转载文字，不仅不付稿酬，甚至也不做通知。虽然此后《读者》杂志出面解释其对整个事件的看法，真实的情况暂时不得而知，但六六的“愤怒”再次引发了公众对于文字作品转载收费的关注，却成为了不争的事实。

　　实际上“六六诉《读者》事件”引发了另一争议性话题，就是上线不足一月的文著协稿酬查询系统“履职”，目前举步维艰，成为议论的焦点。

　　文著协稿酬查询系统于4月26日正式上线，旨在协助著作权人追讨报刊杂志转载文字作品后产生的稿费。“这是文著协职责所在，既是帮助著作权人维护自己的合法权益，降低维权成本，同时也是帮助规范出版环境。”文著协总干事张洪波如此描述系统的主要功能。

　　但他不得不承认，运行已经有一个多月的“稿酬查询系统”遭遇到前所未有的困难，既没有得到广大著作权人的认可，也未对目前文字作品转载稿费收发起到过大的推动作用，可谓“举步维艰”。

　　查询效果不佳

　　文著协推出的“稿酬查询系统”在其官方网站的醒目位置就可以找到链接，记者尝试进入该系统，并进行相关搜索。然而该系统的帮助著作权人收取稿费的效果却大打折扣。记者查询后发现，系统所记录的信息极为有限，目前市场上畅销书的作家、知名的作者如韩寒、郭敬明、慕容雪村等人的作品信息均未收录其中。即便是有的作家有信息被收录，但也很少。例如知名作家贾平凹仅有一条内容被收录其中，这与实际状况相差甚远。

　　“我们承认，目前所收集的信息还很少，系统距离预想还相差一定距离。”张洪波对此向记者坦承，“稿酬查询系统”目前仅有1万多条内容信息， 数量极为有限，而且每天访问网站流量也只有200多次，不算太多。因此，系统运行一个多月以来，真正寻求文著协帮忙追讨稿酬的著作权人并不太多。

　　“信息的搜集整理是长期的工作，对此我们一是希望有更多的著作权人自己主动加入到协会中来，或者留下相关的信息；二是文著协督促报纸、杂志社自觉发放稿费。”张洪波说。

　　记者看到，在文著协网站上，的确留有著作权人登记、注册的相关链接，还有文著协提供的举报邮箱。

　　与此同时，张洪波也谈到，这是一个长期的工程，“系统”要良好地运转起来，必须要得到更多人的支持和信赖，因此“系统”期待进一步被认可，但挡在面前的困难的确不小。

　　业内“冷眼”

　　宁舍稿费也要拼转载

　　“我们首先遇到的麻烦就是，这一系统并未在著作权人那里得到完全了解和认可。”张洪波无奈地说，该系统最大的受益人中国的著作权人实际上对于系统大多完全不了解，很多著作权人根本不知道有这一系统的存在。而知道系统存在的著作权人也仅仅关心一件事儿，“这东西到底能不能帮我要回钱”？

　　“我们经常遇到著作权人抱怨，我的作品被无偿转载了，这里为什么没有我的信息，其实著作权人首先要做的，就是尽快向我们提供这些信息，或者尽快注册成为会员，这样文著协才能有方向性地去做，否则仅仅依靠文著协的力量，又怎么可能完整收录全国所有著作权人的信息。”张洪波说，此外，由于长久以来，文字作品转载稿费收取缺乏有效渠道，并且转载稿费过低，导致部分著作权人因为担心麻烦和得不偿失，并不在意这点钱。

　　有作家曾向记者表示，作为一名畅销书的作家，最主要的收益来源是畅销图书销售的版税和稿酬，比起动辄几十万元的版税，转载追回来的几百、几千元简直九牛一毛，不值得大动干戈，何况转载还能间接扩大作品知名度。

　　“持有这种看法的著作权人不在少数，这是阻碍之一，其实很多著作权人完全没有意识到，当自己的作品被10家、20家刊物不断地转载以后，已经形成了一笔可观的收入。”张洪波分析，更何况该系统也是防止更多侵权、盗版行为的举措之一。

　　稿酬代收

　　机构不一难成合力

　　国家版权局在2009年下发了《关于明确中国文字著作权协会“法定许可”使用费收转职能的复函》，明确了文著协承担报刊转载、教材法定许可使用费转付的法定职能。也就意味着文著协应该是国内惟一具有合法资格的文字作品转载稿费收取和使用的机构。但实际上，却存在机构并存、管理混乱的现状。

　　“现在国内有两个主要的机构从事此项工作，文著协和中国版权保护中心。”张洪波解释说，1991年颁布的《中华人民共和国著作权法实施条例》曾经规定，报刊转载法定许可稿酬由国家版权局指定的机构收转。国家版权局也曾经在1999年出台了《出版文字作品报酬规定》，指定中国版权保护中心从事报刊稿酬转付工作。2002年，《著作权法》及《实施条例》修订后，取消了由国家版权局指定专门机构开展法定许可报酬收转工作的相关规定，允许民事代理。2005年3月1日生效的《著作权集体管理条例》规定：报刊转载、教材“法定许可”使用费的收转机构为著作权集体管理组织。

　　然而，负责报刊转载、教材“法定许可”使用费转付工作的文字著作权集体管理组织——中国文字著作权协会由于种种原因，直到2008年10月才正式成立。

　　“这造成了一段时间的真空期。”张洪波说，在文著协成立之前的几年里，社会多家机构在文著协成立前从事稿酬收转代理。一些作者反映，向代理机构索要稿费到处碰壁，而且这几家社会代理机构也不向社会公布报刊转载信息，作者根本无法查询文章被转载的情况。

　　据了解，曾经承担此项工作的中国版权保护中心之前曾收取了超过2000万元的稿费，目前尚有1000多万元稿酬未被领取，但并未转交给文著协。“作为现在惟一的合法代理机构，我们多次向有关部门反映，但未得到解决。”张洪波无奈地说。

　　缺乏监管

　　部分刊物故意拖延

　　由于合法代理机构本身存在不一致的矛盾，部分报刊杂志也就浑水摸鱼，有意无意地拖欠作者稿费。这种趋势现在比较明显，文著协最近频繁接到著作权人的投诉，尤其是对国内最知名的几家大的文摘类杂志的投诉。张洪波说，很多报刊、杂志都在想办法规避文字作品转载支付稿费，例如在刊物中将转载作品的作者大量以“佚名”的形式出现，还有就是通过对于原创作品重新改写编辑，并署以其他名称。这样就可以堂而皇之地以无法找到作者为由，避免承担稿费。

　　“报刊杂志是否认真履行了，其实我们也根本无从查证。”张洪波表示，文著协正在搜寻相关的证据和涉及到的著作权人，等到时机成熟，不排除用法律的手段，直接进行维权。商报记者 陈杰/文
