加州理工的例子让人们不禁要问:如果真不考虑肤色,完全按学生的素质录取,亚裔在 美国一流大学中究竟要占到什么比例?我们不妨拿出另外一组参照。美国高中,除了公 立、私立外,还有一种考试学校,如波士顿拉丁学校(Boston Latin),纽约的斯特伊 弗桑特高中(Stuyvesant)、布朗士科学高中(Bronx High School of Science) 、旧金山的罗威尔高中(Lowell)、弗吉尼亚的托马斯•杰佛逊高中(Thomas Jefferson High School)等等。这些学校属于公立,但必须经过激烈的入学竞争才能 进入,起毕业生不仅有大量进入一流大学,而且培养了众多诺贝尔奖得主。这些学校的 另一特点,就是只问学业,不考虑种族背景。结果呢,亚裔在这些学校占的比例,高达 40至70%。《华尔街日报》在一篇文章中指出,在斯特伊弗桑特高中今年入学的新生中 ,有九名黑人,24名拉美裔,177名白人,620名亚裔。在纽约的另外两所考试学校,即 培养了八位诺奖得主、录取率比哈佛还低的布朗士科学高中和布碌仑科技高中( Brooklyn Tech),情况也是大同小异。
“Fisher v. University of Texas”白人女生Abigail Noel Fisher 和 Rachel Multer Michalewicz 在2008年申请德州大学奥斯丁分校时被拒绝录取. 由于发现有比 她们成绩低的有色人种学生被录取,她们认为自己受到反向种族歧视, 以宪法第十四 修正案为依据,将学校告上法庭, 并进而要求推翻2003年 Grutter v Bollinger 对平 权法案符合宪法的判决。官司在最高法院审判进行中。

須釐清的是,加州1996年通過第209號提案,由共和黨人提出,具體內容是禁止加州政府以種族與性別作為決定就業、入學與政府合約的標準,並強調是源自1964年聯邦民權法案(Civil Rights Act)的立意精神。但當時民主黨人宣傳,該提案是為取消平權法案的惡法,不利少數族裔。在這種背景下,當時多數華裔民眾遂大力反對209號提案。

Such information is often used to discriminate against people. Why on earth is such information needed if all races are equal?! 3月17日,加州平权修宪案SCA5发起人、州参议员赫尔南德斯(Ed Hernandez)与众议院议长佩雷兹(John A. Perez)发表联合声明,宣布SCA5已经从众议院撤回,返回到参议院。普遍认为,华人此次在反对SCA5中显示力量,是导致SCA5流产的直接原因。
然而就在有人高喊“胜利”后不久,3月25日,加州议会拉丁裔和非裔党团(Latino and Black Legislative Caucus)联合发表声明将继续推动SCA5。对此,加州共和党政治组织“林肯俱乐部”洛杉矶圣盖博谷分会主席何美湄(Mei Mei Huff)认为,此举标志着民主党反击的第一步。
